In a new podcast from the Centre for Business Research, University of Cambridge, Professor Simon Deakin, Director of the CBR, and a Senior Researcher at the CBR Boya Wang discuss with three distinguished Chinese guests the synergies between law and technology in the West and the development of law and technology in China.
Deakin and Wang join in an English Chinese discussion with their guests following a CBR Seminar on 14 May 2018 in Cambridge.
Professors Chen Su,(陈甦), Xie Zengyi, (谢增毅) and Zhao Lei (赵磊) of the Institute of Law, Chinese Academy of Social Sciences (CASS), Beijing, (中国社会科学院), (法学研究所) spoke about The Impact of the Internet on Commercial Law and Labour Law.
Professor Chen Su is Director, Institute of Law, CASS, and a specialist in commercial law. Professor Xie Zengyi, Institute of Law, CASS, is a specialist in labour law. Associate Professor Zhao Lei, Institute of Law, CASS, is a specialist in commercial law. The Institute of Law, founded in 1958, is one of China’s national-level research institutes for the study of law.
Deakin says in this podcast: “We learnt that many of the debates we are familiar with in the West are also happening in China so it has been fascinating to compare the perceptions here of these issues with those which our colleagues from CASS have been explaining to us. In many respects the Chinese regulators appear to be ahead of the game in the sense of addressing issues such as testing and comparison of algorithms in Fintech which really have yet to come on the public agenda here. Fintech has seen a very rapid growth in China with thousands of platforms being established in the last few years. In many respects China is the focal point for global Fintech development. That very rapid economic change in China is forcing regulatory innovation in China so we have a lot to learn from China.”
Wang says in this podcast: “I think we need to also look at the regulatory and legislative flexibility of the Chinese government, and their attitude to this emerging economic phenomena which is very intriguing. “
Deakin concludes: “These are global issues and there is a tremendous opportunity for researchers everywhere to get to grips with these emerging questions, at a point where there is very little academic consensus around some of these issues. I think the study of the relationship between technology and law is a critical issue but so far much of that research had been devoted to showing the law is out of date with technology change. I think we have been shown today that this is a rather naïve view and that technology never really escapes social and legal relationships. I do see great scope here for interdisciplinary research in the future involving lawyers and also experts in technology and social scientists.”
